Here A Justice, There A Justice, Everywhere A Conservative New Judge

The ideology of the Florida State Supreme Court has recently been dramatically reshaped for the next generation.  As promised, Governor Ron DeSantis replaced three state Supreme Court Justices who retired by mandate on January 8th with conservative judges who respect the rule of law and believe the Constitution is supreme, thus putting an end to “judicial activism” on the court.  Justice Barbara Lagoa, Justice Robert J. Luck and Justice Carlos G. Muñiz were selected from a list of finalists among 59 applicants submitted by the Florida Supreme Court Judicial Nominating Commission.  Nine of the eleven final nominees were members the Federalist Society, a conservative legal group who believe, “it is emphatically the province and duty of the judiciary to say what the law is, not what it should be.”  Luck is not a Federalist Society member, but did indicate he was a moderator for a February 2018 Federalist Society conference in Florida.

 

The Florida Supreme Court is composed of seven Justices.  At least five Justices are required to participate in every case, and no less than four must concur to reach a decision.  Historically judges were chosen by direct election of the people, which created ethical issues when candidates needed to raise campaign money that was often donated by the same attorneys who practiced before the Court.  After several Florida appellate judges were charged with violations of ethics, an evolved “merit retention” system was instituted in the mid-70s to seat Florida Justices.  Today when there is a vacancy on the Court, the Governor chooses the next Justice from a list of three to six individuals recommended by a Judicial Nominating Commission.  When Justices’ terms expire, their name is placed on the general election ballot for a merit retention vote if they wish to remain in office.  The ballot question asks: “Shall Justice _____ be retained in office?” The three newly appointed Justices face a merit retention vote in 2020.

Based on the Constitutional separation of powers and the proper role of the courts, judges do not make policy, they simply interpret the law.  Laws, however, do not spell out how they should be applied in every conceivable case, which has resulted in Federal Judges who appear to act like Democratic politicians and create legislation from the bench.  President Trump has been working diligently to resolve this crisis in the federal courts.

As of January 23, 2019, the United States Senate confirmed 85 Article III judges nominated by President Trump, including Associate Justices Neil Gorsuch and Brett Kavanaugh to the Supreme Court of the United States, 30 judges to the United States Court of Appeals and 53 judges to United States District Courts.  There are currently 54 nominations to Article III courts awaiting Senate action, including 9 for the Courts of Appeals, 43 for the District Courts, and 2 for the Court of International Trade.  Additionally, the Senate confirmed 7 Judges in Article I courts; there are currently 3 nominations to Article I courts awaiting Senate action.

Like other judges, the United States Supreme Court Justices preside over civil and criminal court cases with the goal of upholding, enforcing, and interpreting the law, however they uniquely interpret and defend the grandest law in the land: the U.S. Constitution.  The Constitution gives it the power to check, if necessary, the actions of the President and Congress.  The Supreme Court functions as a last resort tribunal and its rulings cannot be appealed except by a subsequent decision of the Supreme Court of the United States.  With the magnitude of the duties of the Supreme Court I find myself wondering… where is Justice Ruth Bader Ginsburg?

Congressman Rooney leads Florida Delegation letter to White House for Everglades Funding

Washington, D.C. – Today, Congressman Francis Rooney sent a letter to President Trump, co-signed by every Member of the Florida Congressional delegation, encouraging the Administration’s continued support of Everglades restoration and water quality infrastructure projects.

Congressman Rooney stated, “The single biggest issue impacting our Southwest Florida community is water quality. Our economy is forever tied to our ecology, and clean water flowing through our rivers, streams and estuaries is the lifeblood of that ecology. We are thankful for the record level of funding that was allocated last year for both the Herbert Hoover Dike and Comprehensive Everglades Restoration Plan projects – a total of over $1 billion. It is critical that we maintain these funding levels so that we may more quickly complete the projects necessary to fix our water.

“The fact that all of our delegation, Republican and Democrat, is united in this cause, is proof of the Everglades’ importance to the future of our State.”

Background:

Joined with $206 million previously appropriated by the House, a total of $610 million will be set aside to complete the Herbert Hoover Dike repairs by 2022 instead of the end of the decade. Every year saved completing these repairs is a year that harmful releases into our ecosystem will stop sooner. Congressman Rooney has successfully fought for funding to complete CERP projects, united the Florida delegation and personally brought House leadership to Southwest Florida to see the watershed first hand. These efforts have led to a record $115 million set aside for CERP in the FY2019 budget. In total, nearly $1.1 billion has been appropriated for dike repairs and CERP projects in FY 2018 and FY 2019.

Electoral College versus 319 Square Miles

In their infinite wisdom, the United States’ Founders created the Electoral College to ensure the STATES were fairly represented. Why should one or two densely populated areas speak for the whole of the nation?

The following list of statistics has been making the rounds on the Internet. It should finally put an end to the argument as to why the Electoral College makes sense. Do share this. It needs to be widely known and understood.

There are 3,141 counties in the United States.

Trump won 3,084 of them.

Clinton won 57.

There are 62 counties in New York State.

Trump won 46 of them.

Clinton won 16.

Clinton won the popular vote by approx. 1.5 million votes.

In the 5 counties that encompass NYC, (Bronx, Brooklyn, Manhattan, Richmond & Queens) Clinton received well over 2 million more votes than Trump. (Clinton only won 4 of these counties; Trump won Richmond)

Therefore these 5 counties alone, more than accounted for Clinton winning the popular vote of the entire country.

These 5 counties comprise 319 square miles.

The United States is comprised of 3,797,000 square miles.

When you have a country that encompasses almost 4 million square miles of territory, it would be ludicrous to even suggest that the vote of those who inhabit a mere 319 square miles should dictate the outcome of a national election.

Large, densely populated Democrat cities (NYC, Chicago, LA, etc.) DO NOT and SHOULD NOT speak for the rest of our country!

And…it’s been verified and documented that those aforementioned 319 square miles are where the majority of our nation’s problems foment.

Whatever Happened to Civility?

In general it’s an outward expression of courtesy and respect. Most of us were raised to say “please” and “thank you “.

We learned it makes our interactions with others more pleasant. Civility, enables us to state our view points and to listen to others. Even though we may agree to disagree it still allows us to have positive relations.

What happened? Civility has been breaking down for a number of reasons. While the culprits are many, the major cause is lack of humility and self awareness.

Too many individuals develop a behavior pattern, where I’m the only one that is important and if you don’t agree with me you are not significant. Also, this manifests itself into groups and institutions.

A prime example is what is happening on our college and university campuses . Different points of view are no longer tolerated. If you are a conservative, believe in the Constitution, individual rights, personal accountability and responsibility you will be verbally attacked and oftener threatened physically for having the audacity to express your beliefs. The progressive movement , how ever you define it, is not tolerant of those who challenge and disagree. Civil discussions are not a part of their agenda.

The shocking culmination of all this lack of civility is elected officials and staff members being harassed in public by groups bought and paid for by the extreme left. Or are these progressives?

If you think this is temporary, think again. It is continuing to deteriorate. Look at the So called Democrats freshman class. When a Member of Congress, Rashida Tlaib refers to the president as a f—-Ing , mother f—-er, its a disgrace to Congress and the district she represents. Even worse the Speaker pushed it a side and ignored it. Even more disturbing is the press fails to report how Tlaib  is openly anti Semitic.

Civility, has become situational. Depends on who you are and if you are politically correct.

A very Happy Year to each of you. Our membership is now over 100. This provides a great opportunity for many of you to participate in one of our several committees.

These groups are very focused on sustaining our Republican ideals. We realize that if we don’t keep educating our youth on what freedom is all about and how our founding fathers built in all the safe guards to sustain this Republic, we will not survive.

Our monthly programming is designed to provide you with a wide variety of knowledgeable speakers to help us better challenge those who would undermine our Republic. For example Socialism and all its isms never go away. It’s like a bad reoccurring dream. So, we continue to fight the fight.

President’s Message – December 2018 – What a Year!

What a year! The growth of our membership, stimulating speakers, major accomplishments with our scholarship programs and a capstone Salute to Veterans Program with Chris “Tanto “Paronto. A hero of Benghazi.

We kept Florida Red In spite of the lefts on slaughter of hundreds of millions of dollars and the corrupt Broward county elections office.

We still hold the Florida House and Senate although we lost 6 seats in the House and one in the Senate. We face many challenges in Florida and State representative Bob Rommel’s resent survey request gives you a great opportunity to make your input.

WATER issues and EDUCATION are Top priorities.

The National Socialist Party , who mask themselves as progressive Democrats, will do everything they can to destroy the Trump Presidency.

Trump plays Chess and they play Checkers. That’s why we expanded our numbers in the Senate. The Senate controls Federal judicial appointments and Supreme Court nominees.

Trade agreements, peace treaties and presidential appointments. In many ways it’s our last chance to slow down the Socialist Train.

2019 will be a challenging year. This is nothing new for us as we continue the fight to save our great Republic, The United States of America.

How often we have seen this slogan and taken it for granted?

Kris Paronto, hero of Benghazi, gave it a deeper meaning in his presentation to us at our annual Salute To Veterans Program to a packed house at the Naples Hilton .

What the Annex Security Team did in saving over twenty American lives is a story that should never be forgotten. They were contractors whose job was security for the CIA annex. When the Embassy was attacked they defied orders and refused to stand down.

You need to read the book 13 Hours, what really happened in Benghazi .

The courage, pure will, to defend Americans abroad is beyond words. We can never thank them enough.

Instead of being treated like the heroes they are, it cost them everything. They were fired, lost all benefits and received no service awards. Lessor personnel received many awards by following orders. It makes you sick.

This is the clincher for me. It was Libyan militiaman that rescued them and a Libyan aircraft that few them out. This is what you get when President Obama lead from behind and Secretary of State Clinton will spend the rest of her life covering her rear end no matter how many times she reinvents herself.

Once again we salute our Veterans and Active duty personnel who defend us regardless of the challenges they face. Yes, Freedom is not Free.
